Being threatened with eviction?
I have been renting a 1 bedroom flat from a private landlord now since October 2008.
In December 2008 i lost my job, but up until this point had always paid my rent.
Due to the current situation within the economy and be able to find work again.. and how hard thats prooving to be.. i quickly fell into arrears with my rent.
I then decided to go and do something i really didn't want to do which made me feel really low, and apply for housing and council tax benefit and also Jobseekers allowance, but once i thought about it, ive probably paid out about 10 grand in my working life in taxes.. so thought why not.
About 3 weeks of to and fro with documents to the local council. i was told id be paid £66 per week. My rent is £100 per week, or £400/4 weekly as i used to pay it. I pay electric on a meter which costs me like £10 - £15 a week because i have storage heating. However i only have to pay £15 a year towards the water rates. There is no gas here either. So its just rent plus electric. I recieve £95.90 fortnightly.
So once i had worked things out.. i have to put, £68 of my fortnightly Jobseekers money, into my rent, to meet the full payment.
Which then leaves me with around £27.90 to live off for 2 weeks. Which basically covers my electric.
Im also dependant on the use of a car, since damaging my hip in an accident 2 years ago.
Then there is the obvious food, and what not usual living expenses.
So how anyone, in this day and age can get by off £27 a fortnight, or £13 a week.. is just beyond me.
As a result, im £600 behind on my rent, and im just handing my landlord the £66 a week i get and told him i will hand him whatever i have spare, ive explained my situation to him.. but if i don't start to clear my arrears off soon, he will either ask me to leave, or face eviction proceedings.
I live alone just to add.
Ive looked through google and that.. but im not sure what right i have? Surely im im paying what i can he has no right to evict me..? IF i wasnt paying at all, then thats a fair point?

i think you would have to get a written agreement that it was acceptable otherwise you would be in breech of contract and that would make him able to evict you after serving you required notice.
speak to the CAB mate and make sure your getting what you should be and also on the rent / possible eviction front.

I was going to say about the DLA thing.
If you aren't receiving DLA or mobility allowance then apply for it.
When you fill out the form, mention EVERY little thing that affects you. Even exaggerate about your hip and mention any pain you get from it. Think of your worst time with your hip etc. and use that for what you write about.
Any extra little bits of money will help you right now.
Things to know when applying, if you can walk further than 75 feet without aid or needing to stop at an average or faster speed, then you may not apply for the mobility. So say you can't do it. Say you walk slowly and have to rest after every 50 feet or so.
If you apply for the car component of mobility then you have the choice of getting a brand new car (possibly you will need to pay a little extra) your tax should be paid for as well as your MOT's, insurance etc. Or you will get £80 a week towards your car, insurance, and general upkeep. So exaggerating about your hip would do you good if you can get the car component.
For DLA, on the lower rate you will get £17.75 a week, though it's paid monthly. Middle rate you will get £44.85 a week and higher rate you will get £67 a week.
For mobility lower rate you will get £17.75 a week and for the higher £46.75.

I did try last year for DLA but they wrote back saying i didn't meet the requirements or qualify for DLA..
Im going to try again though i think.
I tend to think its just old people they bother with that though. ive never heard of someone younger than say 50 getting a brand new car on mobility and that..

You need to speak to your landlord about this situation, and speak to the citizens advice, they will be able to help

My mum has a car on mobility, and she's just a little over 40.
I've just reapplied for DLA hoping to get a higher rate. The money would make things a little easier.
As I say, exaggerate. You don't always have bad days, but there are some bad days that make things very hard.
Say that you have to rely on your car to get places anyway.

Bear in mind that they're currently having a crackdown on people making false or exaggerated disability claims, so being anything other than honest might stand to stop you ever getting it.

I didn't know they were doing that. I'm glad I don't have to exaggerate.
Sadly though, sometimes, without exaggerating, they say that it isn't enough even if it is.

its crap! my wages dont cover all my bills and just flogging stuff on ebay to cover it!, we have just found out that after missis worked her arse off so we can cover all our bills, literally i walked in from work and she walked out the door and worked till 12 ish 5 nights a week... she is better off claiming!! cos my wages have gone from 28k to 18k since moving to devon... yet we are struggling...and now they want to claim back 2k from years ago when we got tax credits
wtf yes like thats gonna happen...to be honest worked it all out... im better off on the dole....will have over 200 after all the bills every month instead of minus figure every month.... makes you sick this country it dont pay to work yet because i couldnt sit on my arse all day like the lazy c**ts in this country who can get a job i suffer... and people who do actually need help and have put into the system get fook all...
Mate turn into a female.. have a kid.. get a free house all your bills, childcare etc etc.
or be an immigrant... get a house, driving license paid for and 2k for a car from the government to help intergrate into sociaty, and you go straight to the top of the housing list bumping all the people who actually need it.....

it an awkward time. i have to pay £32 or my £60.50 IS, on morgage my morgage each week. to be honest their is lots you can do but it all take time and stress. mayby better of trying to get a cheap room let. Look on web site "intittled to" it should give an idea of what they class a exceptable accommadation costs for your area for the accommadation your in. Im fighting benifits to pay more towards my morgage its only £275 pcm if i was in rented they would pay £400 a month its a joke. not like i can borrow from equaty to pay morgage shortful. my mum pays my shopping and my dad helps with bills. I m starting to sell things now to pay them back. If it wernt for my x wife not wanting to leave england I d sell and be gone but cant leave my son behind and wouldn't want to take him away from his mum

Im not downgrading myself to a shared bedsit ever again.. ive lived alone since i was 15 years of age, im 25 now and i have only just got my own flat.. last year i had a en suite bedsit. Im staying put and also flogging on the bay what ive got i don't need, pushbikes, old car stereos and what not, aiming to pay the premium off on my car insurance for the rest of the year (£262 something) then its just rent and electric ive got to find for..
I woke up this morning in agony with my hip, took me 3 attempts to get out of bed,must have slept funny, so im going to see the quack this week, and also going to have a shot at DLA.. but once they feel how much it cracks, clunks and drops in and out of place, they can run me past any medical.. ive got nothing to hide !
Still, 8 jobs in the local paper this week, cleaning jobs, one managerial job and one teaching position.
With what i earn the sad fact is its really not worth me as a single man living alone getting out of bed for less than £250 a week after tax, it really isn't:(
I have a friend who is 19 years of age, and works 3 jobs, days in a warehouse packing, a few nights a week pizza delivery, and a couple of nights a week in a bar, and he still had to take a £900 overdraft out over Christmas to pay bills off, repair his car, and also because he got behind on his rent, if i work out im getting per month in benefits, he is about £60 a week better off than me, but he works 50+ hours a week sometimes and i don't !
Im the brunt of all the dole and benefit dependant jokes at the minute with friends, but i frankly couldn't care less, this country is a joke, in the flats i live in, the whole row of terraced town houses, which is 7 in total, and all 7 have between 3 flats, or 6 bedsits in each one, and im one of two english people living here, everyone else here is foreign, portuguese, polish, iranian, romanian,nigerian, czech... none of them work.. there sat outside all day having barbeques, hanging out the windows jibberjabbin, its like a holiday camp where i live, and all these are blatantly claiming what I'am when frankly i feel they have no right to !
I will take a photo tommorow if i get chance,or whenever the carpark is full next, there is over 30 cars and ive ran them all through the insurance database ive got and about 4 of them are insured, one of them has a tax disc that expired in 2002, and about 9 others arent taxed !!

It's not about being dishonest though, it's about thinking how you're affected on your worst possible day, but you do have to say how bad it really is because otherwise they wont give you anything.
