Being sacked from work.unfair?

I work for a logistics company, won't say who, where they employ lorry drivers and a small 5 man team of van drivers, hi top long wheel base vans.

I got caught speeding on the A1 northbound near lincoln at the end of last month in the work van.

Got the NIP yesterday which doesnt say anything about what im going to get, it just wants to confirm i was driving and to fill out the back of the form and send it back?

I filled it all out apart from signing it, as apparently i don't have to sign it until ive seen photographic evidence.

Sad part is the A1 is a 60, and i was stupid doing 81mph, whats even more said, is i got flashed by the roadworks, which i dont even rememeber, and the limit there was a 50.

With all the credit crisis at the moment, companies will lay off staff wherever they can if they have a good excuse.

Sorry to hear mate, but as tweek said, you gave them an excuse to lay you off. :(

I lost my two supervisors for no reason at all a few weeks ago, they had been in the company since it started. :oooh:

Sorry what i forgot to mention was the reason i believed it was unfair.

One of the other van drivers, who isnt very bright, moved a road closed sign, and drove into 3 foot of water in a flood,the van cut out, and he left it full of stock with the keys in it and went home. They got the van home next day, the company got fined £600 got wasting fire brigade time..

Don't see why im different, its only me thats going to suffer.

Was speaking to a lorry driver for BHS on Wed and after 6yrs of working for them he is been layed off after Xmas so the company can just use agency drivers instead

its happening all over.
was talking to a guy at collage about his company,wont say who but there on scams to get rid of people too, it saves them having to pay any for of redundancy pay etc

thats against the law, if you have a valid reason, and the doctor has given you a sick line, he could sue them for thousands, and i would.

this is what i thought.if your to ill to work and the doctor gives you a sick note they cant sack you.a bloke from my work has been off for a year but they cant sack him becuse of the doctors note.

correct, they dont need to pay you after so long i think, but they cannot sack you if you have a doctors line

sad news mate ask for photos of the incedent not having ago like but what made you do that speed? just if you drive for aliven then you should rely pay more attetion and be more cautious on the roads i need my car for when i have to move to knowsley only 15min drive up the motaway but if i get 1 point i will lose my licance so wont be able to get their with out payin and leaving really early as id have to get 2/3 busses and poss even a train :cry:

can i ask wher you from?
their might be few driveers wanted at my place as 1 of them had a stroke few months back so they struggle might be worth it check out the website as we have companies all over the uk and world

they have jobs pop up now and again for drivers think their was one on the board in work il look tomorrow and see if its stil their not sure wher it was though as i said they are all over the uk


im a lucky one who got the job at the right time the company im working for is actually boomin just spent 3million buyin the company from the old owner and he still owns the land and gets rent lol. they have spent a good 4-6 million on a extension and the 4 of us aero space lads are being moved to even bigger premesis to do bigger jobs

is there anything i could do or say to try and get away with it?

You see the reason behind this is its a new depot, and the gaffa is trying to make a name for himself, anyone does the slightest thing wrong he proper goes to town on the whole disciplinary s**t.

Its only two pieces of paper that say what i did that day with the van reg on, couldnt i say at the last minute i was told to take a different van and my boss was hassling me to go as id wasted time in the warehouse and didnt amend my paperwork, and when the fine came through he said to me if i didnt admit it id be sacked so i didnt admit it to him and he has now sacked me ? theres nothing computerised or solid evidence, just because i filled out two sheets of paper, one being a defect form, one being a run sheet with my deliverys on, whos to say they didnt load the goods onto the wrong van and i got someone elses route that day and we just swapped paperwork but didnt bother changing reg numbers/names ?

This would really cause my gaffa ballache... as if i loose my job and then go to court i cant say i need my job for my licence can i? as i wont have a job:(

Before you try to do anything about it you need to read your contract, if it says anything in there about termination for things like this then you won't have a leg to stand on.

not necessarily, it depends on the paperwork.
As some things needs to be checked and signed by a foreman depending on the business.
If you have not dmitted liability yet, then they need to proe guil, so you cannot be sacked untill guilt is proven. :wink:

Well basically before i leave the depot to go out i fill out a defect form, and a run sheet, which contains mileage at start, time i left, time i got back, finish mileage and signature. none of the managers sign anything until i go home, they sign my paperwork off. im thinking if i fight this and stick to my story maybe this could go my way with lack of evidence? depends on what photographic evidence prooves. hmm.

Another thing i can't get my head around, is that the offence happened at the end of last month, nearly 3 weeks ago, so why did they just suspend me friday for it? i don't know, if they thought i was a danger they wouldnt have let me go out until the disciplinary would they?

Surely if its 3 weeks ago that falls under that 14 day NIP notice, so if they can't prosecute due to the delay surely that means they can't sack you as no offence has been proven against you...?

The reason was they had to let people go due to the credit crisis. It's just the way they've selected people that seems a bit harsh.

he was in a company van, doing 81 in a 50 zone,

the only thing that doesn't smell right is the fact that he's trying to pass the blame to someone else!!
