RE: my speeding offence, confused about 2nd letter?
Further to my last post a few weeks back, about being caught speeding in the workvan.
I have 6 points on my licence and i was caught on fixed GATSO doing 81 in a 50. on the A1 Lincoln during roadworks area.
However i have a photo of the offence, and there is no roadworks, there is just cones laid at the side of the road, actually ont he grass, so they are serviing no purpose?
Anyway more to the point, i reiceved the notice of intended prosecution letter, refused to fill it out asked for evidence, which i reicieved, and then i signed and sent it back.
Today i got a letter back saying basically we are unable to deal with the matter with a fixed penalty notice as your speed was in excess of what is acceptable as a fixed penalty notice, and therefore the matter will be heard in a court hearing. I will reiceive a court date shortly?
Am i getting banned? or is this just a chance to explain myself?
Im confused.. i suffer with anxiety, and its really NOT good for me to have things on my mind.

More than 30 over the limit is a ban as far as I'm aware

As far as I'm aware most police forces will give you a little gap to go over, so say 5mph more and they will ignore it but 31mph over the limit... you're probably looking at loosing your license

If you get your self a decent solicitor ad argue the facts ie it was a 70mph as their was no road work signs and nation speed limit sing was showing. you should only get points if you can proove your case well enough as then its only 11mph over speed limit. You NEED A GOOD SOLICITOR THOUGH REALLY. THE SYSTEM IS HARD TO WORK.

You won't necessarily lose it mate, depends how the court see it, e.g speed, situation, time.
Either one of the 3 things could happen:
1) You lose your license
2) You get 6 points and a medium sized fine
3) You get 3 points and a huge fine
I remember reading in a thread somewhere on here, you need to make sure you wear a suit to court and look smart, make yourself look as innocent as possible, because first impressions count.

See a solicitor mate, it maks a world of a difference, i got stopped last year in a van i had just bought( 2 weeks), and had a worn tyre
But when they checked the MOT was fake and my insurance ran out 7 mins before they stopped me
Now i gave them the details of the guy i bought the van from, so the fake MOT thing i wasnt done for ( although i still got a fine
)
Now when it came to the insurance thing i was s**t myself, as i had 4 points fron 2 and half years ago for speeding, so you think 4+tyre and no insurance = bye bye license
When i went to the solicitor he sid to fear the worst, but still managed to get the no insurance dropped
He provided all my old insurance certificates for the past few years including dayinsure etc, so they could see i wasnt a bad man so they let it go
I very much doubt i could have done that on my own, so it just goes to show, go se a solicitor mate, it will be a big help, especially if you need your a drive for a living

Going to go smart obviously. Will i have to go to the court nearest where it happened? Or will i have to attend local court?
I really dont know what i can say other than apologise, yes it would have been a 70 but because its a goods vehicle max i should have been going is 60mph, but the vans arent restricted? So 11/21 mph over the limit if you look at it in minimal terms.
Really can't be bothered with doing all that again.. ive been driving 5 years next month.. be so hard to do it again with all the bad habits you learn and what not:( id be happy with 11 points on my licence.. temp ban anything but loosing it for good... i think id learn the situation better if i came within my skin of my teeth to loosing it, than if i lost it all together.
I ideally need to find a job out of town, so i can say i need to travel to work, ive already lost one job, i have made the effort even at this difficult time to get another so soon..

does the van weigh over two tonnes if not DOnt beleive its regulated. Amazing really their are so many 4*4 and luxury car drivers who are totally un aware that if a vehicle weighs over 2 2000kg it should not exceed 60mph unless on a motorway (uk law). If you did get a ban Id think you might get 28days or 45days seem to be favourates. which can work out better than points.
3 points on my license ts10 put up my insurance more than a collegue who got a six month ban for drink driveing.

Ah i was reading up on it, 56 days max is a temp ban, anything and ill have to retake my theory and test again ?:(

The court guidelines are 6 points and a fine OR a temp ban (max 56 days), no points and a fine. The fines are calculated by the amount you earn.

iirc if there's a temporary limit on a dual carriageway you can be done for exceeding it, but not, I think, if it's single carriageway (someone correct me if I'm wrong).

You've misread the law there.
It says "car derived van's with a laden weight of over 2 tonnes". That means things like the Transit Connect, not cars that weigh over 2 tonnes.
Incidentally, with a temporary limit it's worth checking if the council have had it enforced correctly and renewed as and when required. If not then it's not valid.

Oh very good point of course, but all they need to do is have the bloody signs up - just because the roadworks aren't in use doesn't mean the temporary limit can be ignored, sadly.

Not so.
They also have to have a valid Temporary Traffic Regulation Order in place, without this the limit is just regarded as an advised limit and so is not legally enforcable.

Interesting as I though that only applied to single carriageway roads and that on dual carriageways and motorways the limit displayed was the limit not an advisory.
